1. Acceptance of Terms
By contracting Mad Cowboys digital process automation services, you accept these terms and conditions. If you disagree, do not use our services.
2. Service Description
Mad Cowboys provides digital process automation services that may include:
- Workflow and business process automation
- Integration between systems and digital tools
- Communication automation (email, WhatsApp, SMS)
- Appointment management and scheduling systems
- Repetitive task automation
- Artificial intelligence solution implementation
- Integration with Google Suite, CRM, and other platforms
- Automated reports and data analysis
- Continuous technical support
Specific services are detailed in the commercial proposal agreed with each client.
3. Eligibility and Registration
To use our services you must:
- Be a legally established company or individual with business activity
- Provide truthful and updated information about your business
- Comply with all regulations applicable to your industry
- Be of legal age and have legal capacity to contract
- Have necessary permissions to automate the requested processes
4. Pricing and Billing
Initial Plan (starting from): $6,999 MXN/month (VAT included)
Includes: Key process automation, standard integrations, technical support
Note: Final pricing is determined through personalized quote based on:
- Complexity of processes to automate
- Number of integrations required
- Transaction or user volume
- Custom functionalities needed
- Support level required
- Each project includes personalized quote based on specific requirements
- Monthly billing in advance (subscriptions) or per project (one-time implementations)
- Payments processed through Stripe (payment link sent via email)
- Credit and debit cards accepted through Stripe
- Subscription cancellation with 30 days prior notice
- Proportional refunds for unused recurring services
- Prices subject to change with 30 days notice
- Additional charges for services outside agreed scope will be notified in advance
5. Client Responsibilities
As a client, you commit to:
- Provide accurate information and necessary access to systems to be automated
- Keep contact information and configurations updated
- Comply with data protection laws applicable to your industry
- Not use services for illegal or unauthorized activities
- Immediately report security or operation issues
- Train your staff on the use of implemented automations
- Maintain independent backups of critical information
- Provide constructive feedback during implementation process
6. Service Limitations
Our services have the following limitations:
- Specific scope: Automations are limited to the scope defined in the commercial proposal
- Third-party dependency: Operation may depend on external services (APIs, platforms)
- Availability: 99.5% uptime for recurring services, with scheduled maintenance
- Compatibility: Limited to compatible systems and platforms as agreed
- Languages: Primarily Spanish, other languages upon consultation
- Specific regulations: Client is responsible for complying with their industry regulations
7. Limitation of Liability
Mad Cowboys will not be responsible for:
- Loss of revenue, data, or business opportunities
- Indirect, incidental, or consequential damages
- Errors in client-provided information or systems
- Service interruptions due to force majeure
- Issues derived from third-party services or integrations
- Business decisions based on automated data without validation
- Misuse or unauthorized use of automations by the client
- Changes in third-party APIs or services affecting operation
Maximum liability limit: Total amount paid by client in the last 12 months.
8. Intellectual Property
Mad Cowboys property:
- Source code, algorithms, and proprietary methodologies
- Templates, frameworks, and internally developed tools
- Interfaces, designs, and documentation
- Trademarks, logos, and marketing materials
Client property:
- All business and customer data of the client
- Specific configurations developed for the client
- Custom integrations as agreed in contract
9. Confidentiality and Data Protection
Both parties commit to:
- Keep confidential commercial and technical information of the other party
- Not disclose customer or end-user data to unauthorized third parties
- Implement appropriate technical and organizational security measures
- Comply with Federal Law on Protection of Personal Data and applicable regulations
- Immediately notify any security breach

10. Warranties and Support
Mad Cowboys guarantees:
- Warranty period: 30 days from implementation for bug fixes at no additional cost
- Technical support: Included according to contracted plan (business hours or 24/7)
- Updates: Maintenance updates included, new features upon consultation
- Documentation: Delivery of basic operation documentation
11. Service Termination
Services may be terminated:
- By client: With 30 days prior notice (recurring services)
- By Mad Cowboys: For serious breach of terms or non-payment
- Automatically: For non-payment after 15 days notification
- One-time projects: Considered terminated upon completion of agreed delivery
Upon termination of recurring services, we will provide:
- Data and configuration export for 30 days
- Documentation of implemented processes
- Basic transition assistance (under separate quote if exceeding 2 hours)
12. Modifications
Mad Cowboys may modify these terms with 30 days prior notice via email notification. Continued use of services after the effective date constitutes acceptance of the new terms.
13. Governing Law and Dispute Resolution
These terms are governed by the laws of the United Mexican States. Parties agree to attempt to resolve any dispute through good faith negotiation. If no agreement is reached, the dispute will be resolved in the competent courts of Mexico City.
14. General Provisions
- Entire agreement: These terms and commercial proposal constitute the complete agreement
- Severability: If any clause is invalid, the others remain in force
- Waiver: Failure to exercise a right does not constitute waiver thereof
- Assignment: Client cannot assign their rights without written consent from Mad Cowboys

Important note: These terms of service are general in nature. Each project includes a specific commercial proposal detailing scope, deliverables, timelines, and particular conditions. In case of conflict between these general terms and the commercial proposal, the provisions in the commercial proposal prevail.
